1) Who we are and scope
Smart Solution (“Smart Solution”, “we”, “us”, “our”) is a digital platform focused on managing and automating investment strategies with an emphasis on transparency and security. We operate exclusively online and are not a bank, credit institution, registered financial advisor, or broker. Trade execution may be carried out through third-party regulated providers/brokers (e.g., Exness Technologies Ltd). This does not mean Smart Solution is regulated or that it provides broker services. This operational detail may vary based on provider availability and risk assessment.
These Terms govern access to and use of the website, dashboard, applications, API, and other services (collectively, the “Platform”). By creating an account, checking “I accept the Terms & Conditions”, and/or using the Platform, you accept these Terms in full.

2) Eligibility and geographic restrictions
You must be of legal age in your jurisdiction and have legal capacity. You may not use the Platform if:
- You are in a restricted or sanctioned jurisdiction (OFAC or other lists);
- Using the service would be illegal under local laws; or
- You have been previously suspended or blocked for violations.
You are responsible for verifying and complying with your country’s rules before using the Platform.
3) Account registration and security
To use core features, you must register, provide truthful information, and keep it up to date. You are responsible for:
- Keeping credentials confidential;
- Enabling and using 2FA (two-factor authentication);
- Notifying us immediately of unauthorized access;
- Taking reasonable cybersecurity measures (devices, networks, antivirus, etc.).
We may require additional verifications (KYC/AML) and limit, suspend, or close accounts if we detect fraud risks, violations, or misuse.
4) Nature of the service (important information)
- Smart Solution does not provide personalized financial advice or individualized recommendations.
- Any performance information, reports, or statistics are for information only and do not guarantee future results.
- Our brand approach requires transparency, verifiable data, and financial education, avoiding “get-rich-quick” promises.
- In some cases, you may view trades in real time via MetaTrader 5 (MT5) provided by integrated third parties.
5) Deposits, withdrawals, and balances
5.1 Supported currencies and network
Deposits and withdrawals are primarily in USDT via the BSC (BEP-20) network. Other currencies or networks may be enabled or suspended at any time for operational or risk reasons.
5.2 Operating minimums
The general minimum to deposit and withdraw is USD 10 (or equivalent). Minimums may change due to network changes, costs, or market conditions; any change will be reflected on the Platform/FAQ.
5.3 Fees, commissions, and gas
Network fees, third-party charges, gas fees, and operational costs may apply. You must confirm the correct address/network and estimate costs before sending. Blockchain transactions are irreversible: if you send to an incorrect address or network, recovery is unlikely.
5.4 Withdrawal availability and timelines
To protect users and strategy, withdrawals may be subject to windows, operational queues, security checks, and reasonable processing times. In exceptional cases (network congestion, maintenance, AML risks, market events), we may delay or split withdrawals to preserve operational integrity.
5.5 Preventive freezes
We may temporarily hold funds upon signals of fraud, impersonation, money laundering, network/address errors, or legal requirements.
6) Operating models and referrals
6.1 Performance model
The Platform may display variable returns from automated and/or third-party strategies. Any “expected return” or growth examples are non-guaranteed estimates presented for educational and transparent purposes (avoiding easy-money claims).
6.2 Referral program
A referral program with user incentives may exist. Percentages, caps, levels, and conditions (e.g., 1 level, 3% direct, etc.) will be published in your dashboard/FAQ and may vary for business or regulatory reasons. Spam and deceptive advertising are prohibited.
7) Content, transparency, and responsible marketing
We commit to an empathetic, transparent, and professional tone; content should educate and demonstrate with verifiable data (e.g., reports, metrics), without promising unrealistic results. Communications may highlight accessibility (USD 10 minimum), MT5 transparency, and layered security, where applicable.
Prohibited:
- “Get-rich-quick,” “get rich effortlessly,” unverifiable absolute comparisons, or “guaranteed return” claims.
- Confusing Smart Solution with similarly named unregulated entities (e.g., “Smart Solutions Bot”). You must clarify that Smart Solution is not associated with such entities.
8) Intellectual property and license to use
All content (software, UI/UX, texts, graphics, trademarks, logos, and domains) belongs to Smart Solution or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Platform under these Terms. Misuse of brand, scraping, reverse engineering, unauthorized reproduction, and use outside permitted purposes are prohibited.
9) Compliance, fraud prevention, and AML/KYC
We may request KYC, additional information, or source-of-funds documentation. We reserve the right to restrict deposits/withdrawals and report suspicious activity to competent authorities. You agree not to use the Platform for illicit activities (fraud, scams, money laundering, illicit financing, sanctions, etc.).
10) Risks
Investing involves the risk of total or partial loss. Cryptoassets involve volatility and technological, counterparty, custody, and regulatory risks (regulatory fragmentation in LatAm warrants special caution). Past performance does not guarantee future results.
11) Disclaimer of warranties
The Platform is provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, or specific results. To the extent permitted by law, we exclude all express or implied warranties (merchantability, fitness for a particular purpose, non-infringement).
12) Limitation of liability
To the maximum extent permitted by law, Smart Solution and its affiliates/partners will not be liable for lost profits, data loss, or indirect or consequential damages. Our total liability for any claim will not exceed (i) the total fees you paid us in the 12 months prior to the claim, or (ii) USD $100, whichever is greater. Nothing above limits liabilities that cannot be excluded by law.
13) Indemnification
You will indemnify and hold us harmless from any claim, damage, sanction, or cost (including reasonable attorneys’ fees) arising from: (i) your use of the Platform in violation of the law or these Terms; (ii) content or communications you post or share; (iii) breaches of responsible marketing or intellectual property.
14) Changes to the Platform and these Terms
We may modify features, providers, pricing, and these Terms to reflect operational, legal, or security changes. We will publish the updated version with an effective date; continued use implies acceptance. Material changes will be communicated by reasonable means (dashboard, email).
15) Suspension and termination
We may suspend or terminate access for security, maintenance, fraud, legal requirements, or violations. You may close your account at any time, subject to the processing of pending withdrawals and legal obligations.
16) Governing law and jurisdiction
These Terms are governed by the laws of the State of Delaware, USA, and any dispute will be submitted, on a non-exclusive basis, to the competent state or federal courts in Delaware, unless mandatory consumer-protection provisions more favorable to you apply.
